Meridian Licence Terms

1. This agreement

These terms form an agreement between you and Mirentha Ltd, a company incorporated in England and Wales (company number 17207914), registered office 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ (“we”, “us”). They govern your use of the Meridian iPhone application and any updates to it (the “App”). By downloading or using the App you accept these terms; if you do not accept them, do not use the App.

This agreement is between you and us alone, not with Apple. Apple is not responsible for the App or its contents.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service, for as long as your subscription is active. The licence is for your own use, personal or professional; it is not a sale, and we keep all rights we do not expressly grant. The App requires iOS 26 or later and is supplied in English only.

3. The subscription, the trial and renewal

Meridian is sold as a subscription: £2.99 per month or £19.99 per year, beginning with a seven-day free trial. The price and the term are shown to you before you confirm, and the price applying in your country and currency is the one the App Store displays.

Apple sells the subscription and takes the payment. Your Apple Account is charged when you confirm the purchase, and again at the start of each renewal period. The subscription renews automatically unless you turn off auto-renew at least 24 hours before the current period ends, and the same applies to the free trial: it becomes a paid period unless you cancel at least 24 hours before it expires. Any unused part of a free trial is forfeited if you buy a subscription during it.

You manage and cancel the subscription in your App Store account settings, not in the App: Settings, then your name, then Subscriptions. We cannot cancel it for you. Refunds are requested from Apple at reportaproblem.apple.com; we cannot issue one ourselves. Nothing in these terms affects your statutory rights, including your right to a repair, replacement or refund if the App is faulty, not as described, or not fit for purpose.

If the subscription lapses, the shoots, trips and spots saved on your device are not deleted by us. What the App can do without an active subscription is set out in the App Store listing.

4. What you may not do

You may not copy, redistribute, rent, lease, sell or sublicense the App; modify it or create derivative works from it; reverse engineer, decompile or disassemble it except to the extent the law expressly permits despite this restriction; remove any proprietary notices or attributions; or use it in breach of any applicable law or export control. You must also comply with any applicable third-party terms of agreement when using the App, including those in section 6.

5. Accuracy, and what the App is not

The App does two different kinds of work, and they carry different confidence. The astronomy — sunrise, sunset, the twilight boundaries, moonrise, moonset, phase, and the paths drawn on the Map and Live tabs — is calculated on your device and is exact within the limits of the model and the coordinate you give it. The weather is a forecast obtained from a third party, and forecasts are uncertain by nature and degrade quickly beyond the first day or two. Cloud figures are a probability, not a promise.

Several things the App does not model are worth stating plainly. Sunset and sunrise are computed against a flat horizon, so local terrain is not accounted for: a hill, a ridge or a building to your west will take the sun earlier than the App says. The Live view depends on the device's compass and can be pulled off true by metal, magnets and magnetic cases. The App does not forecast aurora, atmospheric seeing or transparency, and it does not know about light pollution at your spot, access rights, tides, weather hazards or the state of the ground.

The App is a planning aid for photographers. It is not a navigation, safety or emergency tool, and it should not be relied on where being wrong would put anyone at risk. Judge the conditions, the route and the ground yourself, and tell someone where you are going. To the extent permitted by law we accept no liability for decisions taken on the strength of a prediction the App made.

6. Third-party material and attribution

Weather data is provided by Apple Weather and is subject to Apple's terms; the App carries the attribution Apple requires, linking to Apple's weather attribution and the data sources listed there.

Maps are provided by Apple Maps through MapKit and are subject to Apple's terms. The attributions shown in the App must not be removed or obscured.

7. Privacy

The App collects no personal data and sends nothing to us. What it computes on your device, what it keeps there, the three permissions it asks for and the two Apple services it talks to are set out in the Meridian privacy policy, which forms part of these terms.

8. Warranties

The App is provided “as is”. To the fullest extent permitted by law we exclude all implied warranties, including those of satisfactory quality, fitness for a particular purpose and non-infringement, and we do not warrant that the App will be uninterrupted or error-free, that a forecast will prove correct, or that any prediction will match the conditions you find.

If the App fails to conform to any warranty that cannot be excluded, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation in respect of the App, and any other claim arising from a failure to conform to a warranty is our responsibility.

9. Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are unaffected.

Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue, opportunity or data, arising from your use of the App, including a wasted journey or a missed shot; and our total liability arising out of or in connection with the App is limited to the greater of the amount you paid for it in the twelve months before the claim and £50.

10. Support and maintenance

We are solely responsible for support of the App; Apple has no obligation to provide any maintenance or support services. Support is offered by email at [email protected] and through the Meridian support page.

11. Third-party claims and Apple

We, not Apple, are responsible for addressing any claim by you or a third party relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation. We are also responsible for investigating and defending any claim that the App infringes a third party's intellectual property rights.

You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.

Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and on your acceptance of it Apple has the right to enforce it against you as a third-party beneficiary.

12. Term and termination

This licence runs until terminated. It ends automatically if you breach these terms, and you may end it at any time by cancelling the subscription and deleting the App. Cancelling stops the next renewal; it does not refund the period you are in. Sections 5, 8, 9, 11 and 13 survive termination.

13. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your own jurisdiction.
