Cardetta Licence Terms

1. This agreement

These terms form an agreement between you and Mirentha Ltd, a company incorporated in England and Wales (company number 17207914), registered office 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ (“we”, “us”). They govern your use of the Cardetta iPhone application and any updates to it (the “App”). By downloading or using the App you accept these terms; if you do not accept them, do not use the App.

This agreement is between you and us alone, not with Apple. Apple is not responsible for the App or its contents.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service. The licence is for your own use, personal or business; it is a licence of the software rather than a sale of it, and we keep all rights we do not expressly grant.

3. The free tier, and Cardetta Unlimited

Cardetta is free for one deck and fifty cards in total, with everything else the App does. Adding the fifty-first card or a second deck, whether you type it or import it, raises the subscription screen. That screen never appears during onboarding.

Cardetta Unlimited removes both limits. It is an auto-renewing subscription sold by Apple, monthly or yearly. The price, the length of each period and any free introductory week are shown to you before you confirm, and the price that applies in your country and currency is the one the App Store displays. A free introductory week is offered only to customers Apple treats as eligible for it, and the App mentions one only when it applies to you. If you cancel before a free week ends, you are not charged.

Apple takes the payment and charges your Apple Account when you confirm, or when a free week ends. The subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the period ends, and the next period is charged within the 24 hours before it begins. You can cancel or change plan at any time in Settings › Apple Account › Subscriptions on your iPhone, or from Manage subscription in the App’s settings; a cancelled subscription runs to the end of the period already paid for. Deleting the App does not cancel a subscription. If a subscription’s price goes up, Apple tells you before it applies and, where Apple’s rules or the law require it, asks for your agreement first.

The subscription belongs to your Apple Account rather than to us or to the phone, so it covers every iPhone signed in to that account, and Restore purchases brings it back on a new or reset iPhone at no further charge. It is not shared through Family Sharing.

Refunds are requested from Apple at reportaproblem.apple.com; we cannot issue one ourselves. Nothing in these terms affects your statutory rights, including your right to a repair, replacement or refund if the App is faulty, not as described, or not fit for purpose.

Reaching the free limit, or ending a subscription, never puts your work at risk. Nothing is deleted or hidden: every deck and card you already have stays where it is, remains studiable and remains exportable; only adding more is gated.

4. What you may not do

You may not copy, redistribute, rent, lease, sell or sublicense the App; modify it or create derivative works from it; reverse engineer, decompile or disassemble it except to the extent the law expressly permits despite this restriction; remove any proprietary notices; or use it in breach of any applicable law or export control. You must also comply with any applicable third-party terms of agreement when using the App.

5. Your cards, and material you import

Your cards are your property. We claim no licence over them, and could not use them if we wanted to, since none of them reach us. Nothing the App generates ever modifies the content of a card; scheduling is kept strictly separate from what you wrote.

You are responsible for the material you put into the App. A deck downloaded from elsewhere may be someone else's copyright work and may carry its own terms; importing it into Cardetta does not change that, and whether you may use it is between you and whoever made it. Do not import material you have no right to use.

You are also responsible for your own backups. Cardetta has no server of its own. Where you are signed in to iCloud, your decks, cards and review history sync through your own private iCloud database; images and audio do not, and stay on the iPhone that holds them. That sync is Apple's service under your own iCloud settings, not a backup we run, and we hold no copy and cannot restore anything for you. Deleting the App deletes your decks from that device. Export as .apkg or .csv if you want a copy you control.

6. Scheduling, and what the App is not

Reviews are scheduled by FSRS, an open-source spaced-repetition scheduler, using the grades you give. It is a statistical model of forgetting: it estimates the chance you still remember a card and picks a moment to show it again. Estimates are estimates. The App shows you the numbers behind every decision precisely so that you can judge them rather than take them on trust.

An exam date changes the shape of the queue; it does not create time. Setting one can only bring work forward, and if a deck already fits comfortably in the days remaining you will see no change at all.

Cardetta is a study tool, not a tutor, an examiner or an accreditation body. It does not check whether what is on your cards is correct, and it makes no promise about any grade, qualification or outcome. What you learn, and whether it is right, is yours.

7. Import and export fidelity

Cardetta reads and writes the Anki package format as a courtesy, not as a guarantee of perfect interchange. Anki's own scheduling data does not map onto FSRS, so cards imported from Anki begin as new. Some Anki template features are not reproduced. A .csv cannot carry formatting or media. A deck exported from Cardetta and re-imported into Cardetta keeps its history; other round trips may not. The current, specific limits are listed openly on the support page, and we would rather you read them before you rely on an import than discover them after.

8. Privacy

The App collects no personal data and sends nothing to us. What it stores, what syncs through iCloud and what does not, the one permission it asks for, and its only connections to Apple are set out in the Cardetta privacy policy, which forms part of these terms.

9. Warranties

The App is provided “as is”. To the fullest extent permitted by law we exclude all implied warranties, including those of satisfactory quality, fitness for a particular purpose and non-infringement, and we do not warrant that the App will be uninterrupted or error-free, that any deck will import perfectly, or that any schedule will suit you.

If the App fails to conform to any warranty that cannot be excluded, you may notify Apple, and Apple will refund the purchase price, if any, that you paid for it. To the maximum extent permitted by law, Apple has no other warranty obligation in respect of the App, and any other claims, losses, liabilities, damages, costs or expenses arising from a failure to conform to a warranty are our responsibility.

10. Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are unaffected.

Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue, opportunity or data, arising from your use of the App; and our total liability arising out of or in connection with the App is limited to the greater of £50 and the total you paid for the App, including any subscription, in the twelve months before the event that gave rise to the claim.

11. Support and maintenance

We are solely responsible for support of the App; Apple has no obligation to provide any maintenance or support services. Support is offered by email at [email protected] and through the Cardetta support page.

12. Third-party notices

Scheduling uses swift-fsrs, the open-source Swift implementation of the Free Spaced Repetition Scheduler, under its own licence. It is the App's only third-party code dependency. Anki is a separate project and trademark; Cardetta reads and writes its file format but is not affiliated with, endorsed by or supported by it.

13. Term and termination

This licence runs until terminated. It ends automatically if you breach these terms, and you may end it at any time by deleting the App. Deleting the App neither cancels nor refunds a subscription: cancelling is done in your Apple Account and refunds are Apple’s, as set out in section 3. Sections 5, 6, 9, 10, 14 and 15 survive termination.

14. Third-party claims and Apple

We, not Apple, are responsible for addressing any claim by you or a third party relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation. If a third party claims that the App, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.

You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.

Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and on your acceptance of it Apple has the right to enforce it against you as a third-party beneficiary.

15. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your own jurisdiction. If you are a consumer resident outside the UK, nothing in this section deprives you of the protection of any mandatory law of your country of residence, or of your right to bring proceedings in the courts of that country.
