Talespoke Terms of Use

1. This agreement

These terms form an agreement between you and Mirentha Ltd, a company incorporated in England and Wales (company number 17207914), registered office 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ (“we”, “us”). They govern your use of the Talespoke iPhone application and any updates to it (the “App”). By downloading or using the App you accept these terms; if you do not accept them, do not use the App.

This agreement is between you and us alone, not with Apple. Apple is not responsible for the App or its contents.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the App Store Terms of Service (except that the App may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where Apple allows it). The licence is for your own use; it is a licence of the software rather than a sale of it, and we keep all rights we do not expressly grant.

3. The free tier, and Talespoke Plus

Talespoke is free for one campaign, fully structured, with as many notes as you like, for as long as it runs. Search within that campaign, the index, the timeline and export are all included. Starting a second campaign, or searching across campaigns, raises the subscription screen, which you can also open from the App’s settings.

Talespoke Plus adds unlimited campaigns and search across all of them at once. It is an auto-renewing subscription sold by Apple: £2.49 a month or £14.99 a year in the UK. The price and the length of each period are shown to you before you confirm, and the price that applies in your country and currency is the one the App Store displays.

Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the period ends, and your account is charged for the next period within the 24 hours before it begins. You can cancel or change plan at any time in Settings › Apple Account › Subscriptions on your iPhone, or from Manage subscription in the App’s settings; a cancelled subscription runs to the end of the period already paid for. Deleting the App does not cancel a subscription. If a subscription’s price goes up, Apple tells you before it applies and, where Apple’s rules or the law require it, asks for your agreement first.

The subscription belongs to your Apple Account rather than to the phone, so it covers every iPhone signed in to that account, and Restore purchases brings it back on a new or reset iPhone at no further charge. It is not shared through Family Sharing.

Refunds are requested from Apple at reportaproblem.apple.com; we cannot issue one ourselves. Nothing in these terms affects your statutory rights, including your right to a repair, replacement or refund if the App is faulty, not as described, or not fit for purpose.

Ending a subscription never takes your notes away. Nothing is deleted or hidden: every campaign, note, NPC, thread and place stays readable, searchable within its campaign, and exportable. The campaign you wrote in most recently keeps taking new notes; the others become read-only until Plus is active again, and new campaigns and search across campaigns wait for it too.

4. What you may not do

You may not copy, redistribute, rent, lease, sell or sublicense the App; modify it or create derivative works from it; reverse engineer, decompile or disassemble it except to the extent the law expressly permits despite this restriction; remove any proprietary notices; or use it in breach of any applicable law or export control. You must also comply with any applicable third-party terms of agreement when using the App.

5. Your notes

Your notes, and everything filed from them, are yours. We claim no licence over them, and could not use them if we wanted to, since none of them reach us. The App keeps what you dictated or typed exactly as you said it; the summaries and names it finds sit alongside your words and never replace them.

You are responsible for what you put into the App. If your notes include material from a published adventure, a sourcebook or anyone else’s work, that material’s own terms and any copyright in it are between you and whoever made it.

You are also responsible for your own backups. Your notes are stored only on your iPhone: the App does not sync them, we hold no copy, and we cannot restore anything for you. Your iPhone’s own backups include the App’s data if you have them turned on, and you can export any campaign as Markdown, free, whenever you like.

6. On-device AI, and what the App is not

Talespoke uses Apple’s on-device Foundation Models framework to read your notes, pick out the NPCs, plot threads and places in them, write a one-line summary, and answer questions from your notes when you ask. It is a language model, and it can be wrong: it may miss a name, file something under the wrong kind, misspell what it heard, or decline to read a note it considers sensitive. That is why nothing it finds is saved until you have checked it, why everything it files can be changed or removed by hand, and why an answer in Search always shows the notes it came from.

Automatic filing needs an iPhone that supports Apple Intelligence, with Apple Intelligence turned on, and whether that is available depends on Apple, your device, your language and your region. Without it, the App still works as a notebook you file by hand. Dictation depends on Apple’s speech recognition in the same way.

Talespoke is a note-taking tool. It does not check whether anything in your notes is true, consistent or fair to your players, and it makes no promise about any game.

Talespoke works with any tabletop roleplaying game. The name of a game you type or pick in the App belongs to its owner and is used only to describe what a campaign is played with; Talespoke is not affiliated with or endorsed by any game publisher.

7. Privacy

The App collects no personal data and sends nothing to us. What it stores, the two permissions it asks for, and how dictation and the on-device model work are set out in the Talespoke privacy policy, which forms part of these terms.

8. Warranties

The App is provided “as is”. To the fullest extent permitted by law we exclude all implied warranties, including those of satisfactory quality, fitness for a particular purpose and non-infringement, and we do not warrant that the App will be uninterrupted or error-free, or that anything the on-device model produces will be complete or correct.

If the App fails to conform to any warranty that cannot be excluded, you may notify Apple, and Apple will refund the purchase price, if any, that you paid for it. To the maximum extent permitted by law, Apple has no other warranty obligation in respect of the App, and any other claims, losses, liabilities, damages, costs or expenses arising from a failure to conform to a warranty are our responsibility.

9. Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are unaffected.

Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue, opportunity or data, arising from your use of the App; and our total liability arising out of or in connection with the App is limited to the greater of £50 and the total you paid for the App, including any subscription, in the twelve months before the event that gave rise to the claim.

10. Support and maintenance

We are solely responsible for support of the App; Apple has no obligation to provide any maintenance or support services. Support is offered by email at [email protected] and through the Talespoke support page.

11. Third-party notices

The App is built only with Apple’s own frameworks, including Speech and Foundation Models, and contains no third-party code. Apple Intelligence, Siri and iPhone are trademarks of Apple Inc.

12. Term and termination

This licence runs until terminated. It ends automatically if you breach these terms, and you may end it at any time by deleting the App. Deleting the App neither cancels nor refunds a subscription: cancelling is done in your Apple Account and refunds are Apple’s, as set out in section 3. Sections 5, 6, 8, 9, 13 and 14 survive termination.

13. Third-party claims and Apple

We, not Apple, are responsible for addressing any claim by you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation. If a third party claims that the App, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.

You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.

Apple and Apple’s subsidiaries are third-party beneficiaries of this agreement, and on your acceptance of it Apple has the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

14. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your own jurisdiction. If you are a consumer resident outside the UK, nothing in this section deprives you of the protection of any mandatory law of your country of residence, or of your right to bring proceedings in the courts of that country.
