Testwater terms of use

1. The agreement

These Terms are an agreement between you and Mirentha Ltd ("Mirentha", "we", "us") only, and not with Apple Inc. ("Apple"). Mirentha, not Apple, is solely responsible for the App and its content.

2. Your licence

Mirentha gives you a personal, non-exclusive, non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (https://www.apple.com/legal/internet-services/itunes/), except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing. Testwater Plus is not shared through Family Sharing.

You may not copy, modify, reverse-engineer or redistribute the App, except where the law allows you to do so despite this restriction.

3. Plans and purchases

Free. Without a subscription you can use the App for one tank, with unlimited readings, charts against your target ranges, maintenance tasks and reminders, CSV import and export, and backup and restore, for as long as you like.

Testwater Plus. Testwater Plus is an auto-renewable subscription that adds unlimited tanks, the reef dosing calculator, the planted fertiliser schedule and logging doses from them. There are two plans:

• Plus Monthly: 1 month, £1.99 a month.
• Plus Annual: 1 year, £12.99 a year.

These are the UK prices, in pounds sterling. Prices vary by country, and the App Store shows the price in your currency before you confirm. There is no free trial.

• Payment is charged to your Apple Account when you confirm the purchase.
• The subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period.
• Your Apple Account is charged for the renewal within the 24 hours before the end of the current period.
• You can manage or cancel the subscription in your Apple Account's subscription settings after purchase: on your iPhone, Settings › [your name] › Subscriptions. Cancelling stops the next renewal; Plus stays active until the end of the period you've paid for.

If Plus ends. Nothing you've recorded is deleted. Your oldest tank keeps working as on the free plan. Your other tanks become read-only: you can still view, export and delete them, and their reminders are paused until you subscribe again. The reef dosing calculator and the fertiliser schedule lock on every tank, and your dose history stays readable.

Restoring. To restore Plus on a new iPhone, or after reinstalling, use Restore Purchases in the App's Settings, or Restore Subscription on the subscription screen, while signed in to the same Apple Account.

Refunds. Purchases are made from Apple, and Apple handles refunds. Mirentha can't issue refunds. To ask for one, go to https://reportaproblem.apple.com.

4. Maintenance and support

Mirentha alone is responsible for providing any maintenance and support for the App, as described on its support page (https://mirentha.com/apps/testwater/support/) or as required by law. Apple has no obligation whatsoever to provide any maintenance or support for the App.

5. Warranty

Mirentha is solely responsible for any product warranties, whether express or implied by law, to the extent they have not been effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are Mirentha's sole responsibility.

If you're a consumer in the UK, you have legal rights in relation to digital content that is faulty or not as described. Nothing in these Terms affects those statutory rights.

6. Product claims

Mirentha, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation.

7. Intellectual property

If a third party claims that the App, or your possession and use of it, infringes that third party's intellectual property rights, Mirentha, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that intellectual property infringement claim.

The App, its design, text and code belong to Mirentha. The records you create in the App are yours.

8. Legal compliance

You represent and warrant that (a) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country; and (b) you are not listed on any US Government list of prohibited or restricted parties.

9. Third-party terms

You must comply with any applicable third-party terms of agreement when using the App, such as your mobile network's terms or your Apple Account terms.

10. Apple as third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

11. Using Testwater

• It records what you enter. Testwater keeps the readings you type or import and compares them with the target ranges you set. The starting ranges for each tank type are a guide; adjust them for your livestock. A reading flagged High or Low means it is outside the range you set, nothing more.
• The dosing maths is arithmetic, not advice. The reef dosing calculator and the fertiliser schedule work from the label figures, tank volume, readings and targets you enter. A wrong figure gives a wrong dose. Check each result against the product's own instructions, and test before and after dosing. You decide what goes into your tank and are responsible for it.
• It isn't professional advice. Nothing in the App is veterinary, scientific or water-treatment advice.
• Reminders need notifications. Reminders arrive only if notifications for Testwater are allowed on your iPhone. They're a help, not a guarantee.
• Your data is on your iPhone. We can't recover it if your iPhone is lost or the App is deleted, because we never have a copy. Use Export backup to keep one of your own.
• Imports. You're responsible for having the right to any file you import.

12. Our liability

If we break these Terms or fail to use reasonable care and skill, we're responsible for loss or damage you suffer that is a foreseeable result of that. We aren't responsible for loss or damage that isn't foreseeable, or that is caused by information you entered or imported being wrong. The App is for domestic and private use, and we aren't liable to you for any loss of profit, loss of business or business interruption.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be limited or excluded under the laws of England and Wales. Your statutory rights as a consumer are not affected.

13. Governing law

These Terms are governed by the laws of England and Wales. Any dispute about them will be dealt with by the courts of England and Wales, except that if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
